The Establishment Clause has been the subject of debate and argument since the 1940’s when the Courts ruled initially that providing tax subsidies to families using public transportation to go to private religious schools violates the 1st Amendment prohibition on establishment. The Problem is how do we “incorporate” a right that is designed specifically to not be incorporated?
